U.S. House of Representatives Addendum

1. Scope and order of precedence

This Addendum supplements the Hilltelligence Terms of Service (the “Terms”) and applies to any user who accesses or uses the Service in their official capacity as a Member, officer, or employee of the U.S. House of Representatives (a “House User”). In the event of any conflict between this Addendum and the Terms, this Addendum controls with respect to House Users. Nothing in this Addendum alters the Terms as they apply to any other user.

2. No indemnification by House Users

Notwithstanding any other provision of the Terms, no Member, officer, or employee of the U.S. House of Representatives, nor the House of Representatives or the Federal Government, shall be required to indemnify, defend, or hold harmless First Contact Strategies, LLC or its affiliates for any claims, damages, or losses. Any provision of the Terms that would impose an indemnification, defense, or hold-harmless obligation on a House User acting in their official capacity does not apply to that House User. For clarity, this section waives only obligations that would run from a House User to us; it does not modify Section 7 of the Terms (Limitation of liability) as it applies to our own liability.

3. Ownership of House Data

“House Data” means data, materials, and information uploaded, inputted, or created by a House User in their official capacity — including notes, lists, saved memos and briefing documents, conversation transcripts with the Service’s assistant features, and the work product of analyses generated at the House User’s request. House Data remains the exclusive property of the respective Member or the House of Representatives. First Contact Strategies, LLC claims no ownership of House Data and receives only the limited license necessary to provide the Service to that House User. We will not use House Data to train artificial-intelligence models, will not sell House Data to third parties, and will not use House Data for advertising, marketing, or any purpose other than providing the Service to the specific user.

For clarity, House Data does not include the Service’s underlying software, methodology, models, scoring systems, or the Hilltelligence Analysis made available to users generally (Section 3 of the Terms). Nothing in this Addendum transfers or licenses those proprietary rights to any party.

4. Constitutional protections; legal demands for House Data

Nothing in the Terms or this Addendum shall be construed to waive, diminish, or otherwise affect the constitutional, statutory, or other privileges and immunities of a Member, officer, or employee of the U.S. House of Representatives, including but not limited to the Speech or Debate Clause of the United States Constitution (Article I, Section 6, Clause 1). First Contact Strategies, LLC will not seek to compel testimony or document production from any Member, officer, or House employee relating to official legislative activities.

We will not disclose House Data to third parties. If we receive a subpoena, court order, or other legal demand seeking House Data, we will — unless legally prohibited from doing so — promptly notify the House Office of General Counsel and the affected office before responding, will cooperate with any effort to assert applicable privileges, and will not produce House Data except to the extent legally compelled.

5. Governing law and disputes

Notwithstanding Section 10 of the Terms (Governing law and venue), with respect to House Users, the Terms and this Addendum shall be governed by and construed in accordance with the federal laws of the United States of America, without agreement to the jurisdiction, venue, or governing law of any particular state. Any provision of the Terms requiring mandatory binding arbitration, or waiving the right to participate in a class action, does not apply to House Users.

6. Amendments

Notwithstanding Section 11 of the Terms (Changes), no modification of the Terms or this Addendum applies to a House User until at least 30 days after we provide written notice of the change to the affected office or account holder. No modification will diminish the protections of this Addendum with respect to a then-current subscription without written agreement.

7. Security

We implement industry-standard administrative, physical, and technical safeguards designed to protect the security and confidentiality of accounts and data, and designed to support House Users’ compliance with applicable House information-security policies. We will reasonably cooperate with House information-security reviews of the Service.

8. Data return and deletion

Section 9 of the Terms (Term and termination) applies to House Users: upon termination or expiration of an account or office license, we will provide not less than 30 days to export House Data using the Service’s export tools, after which we will delete the associated House Data from our systems within a commercially reasonable time, except where retention is required by law.
